Terms of Service

These terms are an agreement between you and Favicon Tools governing your use of favicontools.com, including the favicon generator, the verifier, the create flow, the blog, and any related services we offer from this domain (collectively, the “Service”). By using the Service, you agree to these terms. If you do not agree, please do not use the Service.

Eligibility

You must be at least 13 years old to use the Service, or 16 if you live in the European Economic Area. If you are using the Service on behalf of an employer or another organization, you represent that you have authority to bind that organization to these terms.

Acceptable use

You agree to use the Service only for lawful purposes and in a way that does not infringe on the rights of others. You will not:

• Upload images you do not have permission to use, including trademarks or copyrighted material owned by others
• Use the generator to produce icons that impersonate other organizations in a way intended to deceive users
• Probe, scan, or attempt to circumvent security measures, rate limits, or access controls
• Run automated traffic against the Service in a way that degrades availability for other users
• Use the Service to distribute malware, phishing pages, or other harmful content
• Resell access to the Service without our written permission

We may suspend or terminate access for any account or IP address that violates these rules.

Your content

You retain ownership of any image, logo, or other content you upload to the Service. By uploading content, you grant Favicon Tools a limited license to process that content for the purpose of producing the favicon kit you requested. We do not claim any ownership over your content, and we do not use your content for any purpose other than fulfilling your request, as described in our privacy policy.

Generated output

The favicon kit produced by the Service, including the ICO file, PNG icons, and manifest.json, is yours to use under the terms of whatever license applies to the source image you provided. We do not claim any rights in the generated output. You are responsible for confirming that the source image you upload is one you have the right to use.

Our intellectual property

The Favicon Tools name, the favicontools.com domain, the site design, the source code, the underlying tooling, and any written content we produce (including blog posts and documentation) are owned by us or our licensors and are protected by copyright, trademark, and other laws. These terms do not grant you any license to our trademarks, logos, or proprietary code outside of using the Service in the normal way.

Accounts

If you choose to create an account, you are responsible for the activity that happens under your credentials. Keep your password secure, do not share your account, and notify us at support@favicontools.com if you suspect unauthorized access. We may suspend accounts that show signs of abuse or that violate these terms.

Third-party services

The Service relies on third-party providers, including but not limited to Vercel, Clerk, PostHog, and Resend. Your use of those providers through the Service is subject to their respective terms. We are not responsible for the availability, accuracy, or conduct of third-party services we link to from the site, including any links in our blog.

No warranty

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, that the generated output will meet every platform requirement now or in the future, or that defects will be corrected. You use the Service at your own risk.

Browser, operating system, and platform requirements for favicons and web app manifests change over time. We work to keep the generator aligned with current guidance, but you are responsible for confirming the output meets your specific deployment needs before publishing it.

Limitation of liability

To the maximum extent permitted by law, Favicon Tools and its contributors will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, arising from or related to your use of the Service, even if we have been advised of the possibility of such damages. Our total liability for any claim related to the Service will not exceed the greater of the amount you paid us in the past 12 months or 50 USD.

Indemnification

You agree to indemnify and hold Favicon Tools harmless from any claim, demand, loss, or expense (including reasonable legal fees) arising out of your breach of these terms, your misuse of the Service, or your violation of any law or third-party right.

Termination

You may stop using the Service at any time. We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these terms or if we discontinue the Service. Provisions that by their nature should survive termination (including intellectual property, warranty disclaimers, and limitation of liability) will survive.

Governing law

These terms are governed by the laws of the jurisdiction in which Favicon Tools is operated, without regard to conflict-of-law principles. Any dispute arising out of or related to these terms or the Service will be brought exclusively in the courts of that jurisdiction, and you consent to personal jurisdiction there. The specific governing jurisdiction is identified in our publicly listed business details and is available on request to support@favicontools.com.

Changes to these terms

We may update these terms from time to time. When we make a material change, we will update the “Last updated” date at the top of this page and, where appropriate, surface a notice in the Service. Continued use of the Service after the changes take effect constitutes acceptance of the new terms.
